These Terms of Use govern the use of Lumus Player in all of its versions: the app for phones, tablets, Android TV and Google TV, the browser version and the website. By creating an account, signing in or using any of them, you agree to these Terms and to our Privacy Policy.
Please read them carefully, especially sections 4 and 5. They explain that Lumus Player is only a media player and that choosing the content sources is always up to you.
1. Who we are
Lumus Player is a media player app developed and maintained by the Lumus Player team, referred to in these Terms as "we" or "us".
You can reach us through the channels listed in section 22.
2. Acceptance, age and capacity
- By creating an account, signing in or using Lumus Player, you confirm that you have read, understood and accepted these Terms. If you do not agree, do not use the service.
- You must be at least 13 years old. Between 13 and 18, use requires the permission and supervision of a parent or guardian, who is responsible for the actions and purchases made on the account.
- Lumus Player is for personal and household use. Commercial use or use on behalf of a company requires our written permission.
3. What Lumus Player is
Lumus Player is a media player. It organizes and plays Xtream Codes and M3U8 playlists and other sources that you add yourself, with features such as a program guide, profiles, favorites, history, search, downloads to watch offline and parental controls.
- App for Android phones and tablets.
- App for Android TV and Google TV.
- Browser version for computers and TVs, available during the free trial or with Premium.
- The iPhone and iPad app is in development, with no guaranteed release date.
Features may change over time, as described in section 14.
4. Lumus Player does not provide content
Lumus Player does not sell, provide, host, suggest, index or recommend playlists, channels, movies, series or any other audiovisual content. The app comes empty: everything shown in it comes from the sources you add.
- We have no commercial relationship, partnership or affiliation with playlist or channel providers.
- We do not control, review or approve what sources stream, and we do not guarantee the quality, legality, availability or accuracy of that content.
- Posters, synopses, cast and ratings may come from the source itself or from third-party public databases such as TMDB. This information only identifies the content and does not mean it is licensed.
- In the browser version, so that playback works, our servers relay the stream from the source you added in a technical, automatic and real-time way, without selecting, editing or storing the content.
- Downloads stay only on the device or browser where they were made, for personal use, and follow the same legality rules as the source they came from.
5. Your responsibility for sources
- You may only add sources you have the right to access, such as licensed services you subscribe to, your own content or content released by the rights holder.
- Choosing, contracting and using sources is your sole responsibility, as is complying with the law, including the Brazilian Copyright Law, Law No. 9,610 of 1998.
- Accessing, downloading or sharing pirated content may be a crime and may create a duty to compensate third parties. These consequences fall exclusively on whoever added and used the source.
Because we do not host content, takedown requests must be sent to whoever is responsible for the source. Even so, if a rights holder informs us that Lumus Player is being used to infringe their rights, we may take the measures within our reach, such as suspending the account involved. We comply with the court orders we receive, under the Brazilian Internet Civil Framework, Law No. 12,965 of 2014.
6. Your account
- Provide accurate information and keep your email up to date. It is our official channel with you.
- You are responsible for your password and for everything that happens on your account. We recommend turning on two-step verification and telling us if you notice any misuse.
- If you sign in with your Google account, access is also subject to Google's terms.
- Your account is personal. It may be used by you and the people in your household, through profiles, but it may not be sold, rented, lent or shared with third parties.
- Each account may have up to 5 playlists.
- So that your playlists appear on all your devices and in the browser version, the addresses and credentials of the playlists you add are saved to your account in a protected way and are only used to access the sources at your request.
7. Free trial, subscription and payment
To watch, you must be on the free trial or have an active Premium subscription. Without an active plan, the account still exists, but playback is blocked.
7.1 14-day free trial
- It is granted automatically on the first sign-up made through the app, on a phone or TV. Accounts created on the website start without the trial.
- It can only be used once per device and per person.
- It does not require a card and does not turn into a subscription by itself: when the 14 days end, playback is blocked until you subscribe, with no automatic charge.
- Creating new accounts, changing device identifiers or using any other trick to repeat the trial is prohibited and may lead to the suspension of the accounts involved.
7.2 Premium subscription
- It is purchased and billed through Google Play, in monthly, quarterly, semiannual or annual periods, at the price shown in the store at the time of purchase.
- It renews automatically at the end of each period, for the same term, until canceled.
- You can cancel at any time on Google Play. Access continues until the end of the period already paid for.
- New prices only apply to later periods and are announced in advance by Google Play, which asks for your consent when the law or the store requires it.
- If a payment is reversed or disputed, the corresponding Premium access is canceled.
- When the iPhone and iPad app is released, purchases made in it will follow the App Store rules.
7.3 Withdrawal and refunds
You may withdraw from your first purchase within 7 days, under article 49 of the Brazilian Consumer Protection Code, by requesting a refund through Google Play or through the channels in section 22. In other cases, refunds follow Google Play's rules, without prejudice to your other consumer rights.
Deleting your account or uninstalling the app does not cancel your Google Play subscription. To stop the charges, cancel it in the store itself.
8. Browser version
- It is available during the free trial or with Premium and uses the same account as the app.
- It works in current computer and TV browsers. Because it does not convert video, some formats may not play in the browser, and some features may differ from the app.
- For security, your session may end during service updates, and you will need to sign in again.
- Downloads made in the browser are stored in it and may be deleted by the browser itself or by you.
9. Your data on the device
Favorites, progress, history, preferences and parental controls are stored only on the device or browser where you created them. We do not keep a cloud copy of them. Uninstalling the app, clearing its data or changing devices may delete them permanently.
How we process your personal data is described in the Privacy Policy, which is part of these Terms.
10. Parental controls
- They are a support tool. The PIN is stored only on the device, and no one on our team has access to it.
- Categories and ratings come from the sources you add and may be wrong or incomplete.
- Parental controls do not replace supervision by parents or guardians.
11. Bugs and suggestions
The Bugs and suggestions area is available during the free trial or with Premium.
- Tickets and conversations may be seen by other users of this area, with your email masked. Tickets about subscriptions and accounts are visible only to you and to our team.
- Do not post passwords, payment details, personal data about yourself or others, playlist addresses or credentials, or illegal, offensive or discriminatory content.
- Our team may edit, hide, close or delete tickets and comments that break these Terms or go off topic.
- You still own what you write, but you allow us, free of charge and on a non-exclusive basis, to display that content within the service and to use your suggestions to improve Lumus Player, with no obligation to implement them or to pay for them.
12. What is not allowed
- Using Lumus Player to access, download or share pirated or illegal content, or adding sources you do not have the right to access.
- Reselling, renting or sublicensing access, retransmitting content or showing it in places open to the public, such as bars, hotels and shops.
- Getting around the free trial, payment, access control or any other limit of the service.
- Decompiling, reverse engineering, modifying or creating derivative versions of the app, except where the law allows it.
- Distributing the app through unofficial channels or installing modified versions.
- Accessing our systems without authorization, testing vulnerabilities without permission, overloading the infrastructure or using bots, scrapers and automation.
- Using the Lumus Player brand without permission or pretending to be our team.
- Breaking the law or the rights of third parties in any other way.
13. Intellectual property
The Lumus Player app, website, brand, logo, code, design and texts belong to us or to our licensors. We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use Lumus Player in accordance with these Terms. No other rights are transferred.
Third-party brands mentioned, such as Google Play, Android TV, Google TV, App Store and TMDB, belong to their respective owners.
14. Availability and changes to the service
- We work to keep the service stable, but we do not guarantee uninterrupted or error-free operation. It depends on third parties, such as sources, the internet, Google Play and cloud providers.
- We may carry out maintenance, change, add or remove features, retire old versions and require app updates. Changes that matter to subscribers will be announced in advance.
- If we decide to shut down the service, we will give reasonable advance notice and handle periods already paid for in accordance with the Brazilian Consumer Protection Code.
15. Suspension and termination
15.1 By you
You can delete your account at any time in the app settings, under Delete my account. Deletion is scheduled and can be canceled if you sign in again within 3 days. After that, the account data is permanently deleted, except for what the law requires us to keep. Remember to cancel your subscription on Google Play.
15.2 By us
We may suspend or terminate accounts in case of a breach of these Terms, fraud, payment reversal, a court order, a risk to the security of the service or use that exposes us to legal liability. When the measure is not urgent and does not result from a court order, we will notify you first and you may respond through the channels in section 22. In case of a serious breach, the current period is not refunded, without prejudice to consumer rights.
16. Limits of our liability
To the fullest extent permitted by law, and without removing consumer rights that cannot be waived, we are not liable for:
- the content, legality, quality or availability of the sources you add;
- failures caused by the internet, your device, your browser, Google Play or other third-party services;
- loss of data stored only on the device, as described in section 9;
- damages resulting from using Lumus Player in breach of these Terms or of the law.
Nothing in these Terms excludes our liability for damages we cause through fault or willful misconduct, nor limits rights guaranteed by the Brazilian Consumer Protection Code.
17. Liability for misuse
If your use of Lumus Player in breach of these Terms or of the law leads to a complaint, a lawsuit or a loss for us or for third parties, you will be liable for the damages you cause, as provided by law.
18. Communications
We contact you through your account email and through notices in the app and on the website. Keep your email up to date so you do not miss important messages. We never ask for your password, PIN or payment details by email, phone or message.
19. Changes to these Terms
We may update these Terms. The date of the version in force is always at the top of the document. Relevant changes will be announced in the app, on the website or by email at least 7 days in advance. If you keep using the service after the new version takes effect, you agree to it. If you do not agree, you can stop using Lumus Player and cancel your subscription.
20. General provisions
- These Terms and the Privacy Policy form the entire agreement between you and us about the use of Lumus Player.
- If any clause is found invalid, the others remain in force.
- Not enforcing a rule does not mean waiving it.
- The Portuguese version of these Terms prevails over translations.
21. Governing law and jurisdiction
These Terms are governed by the laws of Brazil. The courts of the consumer's place of residence have jurisdiction over any dispute, under the Brazilian Consumer Protection Code. Before going to court, talk to us: most problems are solved through the channels below.
